THE COMMITTEE ON TRANSPORTATION

To whom was referred a Bill (S. 1015), to amend Section 57-1-320, Code of Laws of South Carolina, 1976, relating to term limitations on Department of Transportation commissioners, etc., respectfully

REPORT:

That they have duly and carefully considered the same, and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by striking all after the enacting words and inserting:

/ SECTION 1. Section 57-1-320 of the 1976 Code is amended to read:

"Section 57-1-320. (A) A county that is divided among two or more Department of Transportation districts, for purposes of electing a commission member, is deemed to be considered in the district which contains the largest number of residents from that county.

(B) No A county within a Department of Transportation district shall not have a resident commission member for more than one two consecutive term terms and in. A resident commission member who completes a second consecutive term must be replaced by a person who resides in another county within the district. In no event shall any two persons from the same county serve as a commission member simultaneously except as provided hereinafter."

SECTION 2. This act takes effect upon approval by the Governor. /

The Department of Transportation states there would be no impact to the General Fund of the State nor on federal and/or other funds if this bill were to be enacted.

A BILL

TO AMEND SECTION 57-1-320, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO TERM LIMITATIONS ON DEPARTMENT OF TRANSPORTATION COMMISSIONERS, SO AS TO ELIMINATE THE RESTRICTION THAT PREVENTS A COMMISSIONER FROM SERVING CONSECUTIVE TERMS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 57-1-320 of the 1976 Code is amended to read:

"Section 57-1-320. (A) A county that is divided among two or more Department of Transportation districts, for purposes of electing a commission member, is deemed to be considered in the district which contains the largest number of residents from that county.

(B) No county within a Department of Transportation district shall have a resident commission member for more than one consecutive term and in In no event shall any two persons from the same county serve as a commission member simultaneously except as provided hereinafter."
