THE COMMITTEE ON JUDICIARY

To whom was referred a Concurrent Resolution (S. 1119), to memorialize Congress to enact and submit to the states for ratification an appropriate amendment to the United States Constitution allowing prayer in schools, etc., respectfully

REPORT:

That they have duly and carefully considered the same, and recommend that the same do pass:

A CONCURRENT RESOLUTION

TO MEMORIALIZE CONGRESS TO ENACT AND SUBMIT TO THE STATES FOR RATIFICATION AN APPROPRIATE AMENDMENT TO THE UNITED STATES CONSTITUTION ALLOWING PRAYER IN SCHOOLS IN ALL CIRCUMSTANCES.

Whereas, the United States Supreme Court in various cases has ruled under the United States Constitution that it is unconstitutional to require students to participate in religious instruction or school prayer or to require students to participate in school activities or functions where religious instruction or prayers will be offered; and

Whereas, the members of the South Carolina General Assembly believe that prayer in schools should be an integral part of student instruction and that the United States Constitution should be appropriately amended to permit prayer in schools in all situations and not just on a voluntary basis. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That the members of the South Carolina General Assembly hereby memorialize the Congress of the United States to enact an appropriate amendment to the United States Constitution and submit to the states for ratification provisions allowing prayer in schools in all circumstances.

Be it further resolved that a copy of this resolution be forwarded to

the United States Senate, the United States House of Representatives, and to each member of the South Carolina Congressional Delegation.
