A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 8-11-17, SO AS TO EXTEND ELIGIBILITY FOR STATE EMPLOYEE BENEFITS TO TEMPORARY STATE EMPLOYEES, TO REQUIRE TEMPORARY EMPLOYEES TO MEET THE SAME ELIGIBILITY REQUIREMENTS APPLICABLE TO PERMANENT EMPLOYEES, AND TO PROHIBIT DISCRIMINATION IN THE HIRING OF TEMPORARY EMPLOYEES BASED ON THIS ELIGIBILITY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Article 1, Chapter 11, Title 8 of the 1976 Code is amended by adding:

"Section 8-11-17. (A) Temporary employees of state agencies and institutions are considered permanent state employees for purposes of determining eligibility for all state employee benefits if the temporary employee:

(1) performs duties similar to those of agency full-time permanent employees; or

(2) the employee has been employed for a total of one year or more within the previous two years, regardless of whether or not it is uninterrupted service.

(B) Temporary employees must meet all eligibility requirements for these benefits applicable to permanent state employees.

(C) An agency may not discriminate in the hiring of a temporary employee on the basis of the employee's eligibility under this section."

SECTION 2. This act takes effect upon approval by the Governor.
