A JOINT RESOLUTION

TO APPROVE REGULATIONS OF THE STATE LAW ENFORCEMENT DIVISION, RELATING TO THE STATE DNA DATABASE, DESIGNATED AS REGULATION DOCUMENT NUMBER 2316, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The regulations of the State Law Enforcement Division, relating to the State DNA Database, designated as Regulation Document Number 2316, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.

SECTION 2. This joint resolution takes effect upon approval by the Governor.

SUMMARY AS SUBMITTED

BY PROMULGATING AGENCY.

The South Carolina General Assembly added Sections 23-3-600 through 23-3-690 to the Code of Laws, creating the Deoxyribonucleic Acid (DNA) Identification Record Database (State DNA Database) at the State Law Enforcement Division (SLED). Section 23-3-690 requires SLED to promulgate regulation regarding processing DNA samples. The State Law Enforcement Division will develop DNA profiles on samples for law enforcement, humanitarian and nonlaw enforcement purposes. Samples for inclusion in the database must be provided by persons convicted or adjudicated delinquent of criminal sexual conduct in the first or second degree, criminal sexual conduct with a minor in the first or second degree, assault with intent to commit criminal sexual conduct, and offenders as ordered by the court. The suggested language allows for the orderly implementation of the DNA Databank program by defining terms used in the regulation; describing the collection and identification of samples; handling, transporting and shipping of samples and procedures for DNA testing, typing and analysis of samples.
