THE COMMITTEE ON TRANSPORTATION

To whom was referred a Bill (H. 4139), to amend Section 56-1-2100, as amended, Code of Laws of South Carolina, 1976, relating to a commercial driver license, so as to establish an "S" endorsement, etc., respectfully

REPORT:

That they have duly and carefully considered the same, and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by adding an appropriately numbered section to read:

/ SECTION ( ). Section 56-1-2070(C)(1) of the 1976 Code, as amended by Act 258 of 1998, is amended to read:

"(1) active duty military personnel; and reservists and National Guard members who are on active duty members of the military reserve; members of the South Carolina National Guard who are on active duty, including personnel on full-time South Carolina National Guard duty; personnel on part-time South Carolina National Guard training and South Carolina National Guard Military technicians required to wear uniforms; and active duty military United States Coast Guard personnel while operating vehicles owned or operated by the United States government, unless they are required by the owner of the vehicle to have a valid state driver's license; or this State for military purposes. This exception does not apply to technicians in the United States Reserves." /

Renumber sections to conform.

ESTIMATED FISCAL IMPACT ON GENERAL FUND EXPENDITURES IS:

ESTIMATED FISCAL IMPACT ON FEDERAL & OTHER FUND EXPENDITURES IS:

$0 (No additional expenditures or savings are expected)

EXPLANATION OF IMPACT:

The Department of Public Safety states the cost to implement this legislation is $8,000 in recurring state funds for annual printing of school bus testing sheets (20,000 annually @ .40 cents each) and $17,000 in non-recurring state funds for the development of a computer program (500 hours @ $30 per hour = $15,000) and development of a school bus test with the Department of Education ($ 2,000). The total first year cost is $25,000.

A BILL

TO AMEND SECTION 56-1-2100, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO A COMMERCIAL DRIVER LICENSE, SO AS TO ESTABLISH AN "S" ENDORSEMENT WHICH AUTHORIZES A PERSON TO DRIVE DEPARTMENT OF EDUCATION SCHOOL BUSES OR SCHOOL DISTRICT OWNED ACTIVITY BUSES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 56-1-2100(B)(2) of the 1976 Code, as last amended by Act 258 of 1998, is further amended to read:

"(2) Endorsements:

(a) 'H' authorizes the person to drive a vehicle transporting hazardous materials;

(b) 'T' authorizes double trailers;

(c) 'P' authorizes driving vehicles carrying passengers;

(d) 'N' authorizes driving tank vehicles;

(e) 'X' represents a combination of hazardous materials or tank vehicle endorsements, or both;

(f) 'S' authorizes the person to drive Department of Education school buses or school district owned activity buses."

SECTION 2. This act takes effect upon approval by the Governor.
