TO AMEND SECTION 7-19-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE MANNER OF FILLING VACANCIES IN THE OFFICE OF UNITED STATES SENATOR, SO AS TO PROVIDE THAT THE GOVERNOR MAY FILL THE VACANCY BY APPOINTMENT OF A PERSON WHO HAS DECLARED HIMSELF TO BE A MEMBER OF THE SAME POLITICAL PARTY AS THE IMMEDIATELY PRECEDING SENATOR WHO VACATED THE OFFICE, AND DECLARED HIS INTENTION IN SUCH AFFIDAVIT TO SERVE IN THE OFFICE AS A MEMBER OF THAT POLITICAL PARTY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 7-19-20 of the 1976 Code is amended to read:
"Section 7-19-20. In case of a vacancy in the office of United States Senator from death, resignation, or otherwise, the Governor may fill the place vacancy by appointment which of a person who has by affidavit furnished to the Governor declared himself to be a member of the same political party as the immediately preceding Senator who vacated the office and in such affidavit declared his intention to serve in the office as a member of that political party. The appointment shall be for the period of time intervening between the date of such the appointment and January third following the next succeeding general election. But in In the event any such the vacancy shall occur less than one hundred days prior to any a general election, the appointment shall be for the period of time intervening between the date of such the appointment and January third following the second general election next succeeding. The Governor shall within five days after any such the appointment order an election to be held in connection with and at the time of the general election immediately preceding the expiration date of such the appointment if at the expiration of such the appointment an unexpired term shall remain."
SECTION 2. This act takes effect upon approval by the Governor.
