A BILL

TO AMEND SECTION 56-1-40, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PERSONS WHO MAY NOT OBTAIN A DRIVER'S LICENSE OR HAVE A DRIVER'S LICENSE RENEWED, SO AS TO PROVIDE FOR THE ISSUANCE OF A DRIVER'S LICENSE TO A PERSON FROM ANOTHER COUNTRY WHO POSSESSES A UNITED STATES IMMIGRATION AND NATURALIZATION SERVICE I-94 CARD.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 56-1-40(7) of the 1976 Code, as last amended by Act 497 of 1994, is further amended to read:

    "(7)    who is not a resident of South Carolina, except for persons from other countries who are present in South Carolina:

        (a)    on a student visa or on a work visa or the dependents of the student or worker who may be issued a license. However, the granting of the license is not evidence of meeting the residency requirements of Section 59-112-20, or

        (b)    possesses a United States Immigration and Naturalization Service I-94 card;"

SECTION    2.    This act takes effect upon approval by the Governor.
