To whom was referred a Bill (S. 863) to amend Section 23-15-140, Code of Laws of South Carolina, 1976, relating to the official badge of deputy sheriffs, so as to provide that a correctional officer, etc., respectfully

EXPLANATION OF IMPACT:
There would be no fiscal impact on the General Fund of the State, nor on federal and/or other funds.
LOCAL GOVERNMENT IMPACT:
Enactment of this bill would have a minimal fiscal impact on the local governments, which can be absorbed by the locality.

TO AMEND SECTION 23-15-140, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE OFFICIAL BADGE OF DEPUTY SHERIFFS, SO AS TO PROVIDE THAT A CORRECTIONAL OFFICER WHO IS EMPLOYED BY A COUNTY OR MUNICIPAL DETENTION FACILITY ON OR BEFORE DECEMBER 31, 2002, MAY WEAR A BADGE THAT CONSISTS OF OR INCORPORATES THE SHAPE OF A FIVE-POINTED OR SIX-POINTED STAR WITH A REPLICA OF THE GREAT SEAL OF SOUTH CAROLINA INSCRIBED IN ITS CENTER.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 23-15-140 of the 1976 Code, as added by Act 109 of 2001, is amended to read:
"Section 23-15-140. (A) The purpose of this section is to provide for uniformity among sheriffs and deputy sheriffs, and to aid the public in identifying a sheriff and deputy sheriff.
(B) A badge that consists of or incorporates the shape of a five-pointed or six-pointed star with a replica of the Great Seal of South Carolina inscribed in its center is the official badge to be worn by all sheriffs and deputy sheriffs throughout the State.
(C) Except as provided in subsection (D), It it is unlawful for a person who is not a sheriff or deputy sheriff to present himself as such by wearing or presenting the official badge described in subsection (A).
(D) A correctional officer who is employed by a county or municipal detention facility on or before December 31, 2002, may wear a badge that consists of or incorporates the shape of a five-pointed or six-pointed star with a replica of the Great Seal of South Carolina inscribed in its center.
(D)(E) A person who violates the provisions of this section, upon conviction, must be fined not more than one hundred dollars, or imprisoned not more than thirty days."
SECTION 2. This act takes effect upon approval by the Governor.
