STATEMENT OF ESTIMATED FISCAL IMPACT

REVENUE IMPACT1

This Joint Resolution is not expected to have an impact on state or local revenues in FY 2000-01.

Explanation

The Appellate Conflict Fund provides money to pay private attorneys that represent indigents in appeals when the Office of Appellate Defense is unable to do so. This resolution overrides Proviso 35.3 in Part 1B of Act 387 of 2000 to allow the Office of Indigent Defense to spend a maximum of $35,000 in FY 2000-01 as retroactive reimbursement for all outstanding expense vouchers related to appeals cases for the FY 1992-93 to FY 1999-00 period. Since the resolution merely alters the payment schedule for attorneys, it would have no impact on state or local or revenues in FY 2000-01.

    Board of Economic Advisors

1/ This statement meets the requirement of Section 2-7-71 for a state revenue impact, Section 2-7-76 for a local revenue impact, and Section 6-1-85(B) for an estimate of the shift in local property tax incidence.

A JOINT RESOLUTION

TO MAKE RETROACTIVE PAYMENTS OF OUTSTANDING VOUCHERS IN THE OFFICE OF INDIGENT DEFENSE'S APPELLATE CONFLICT FUND FROM JULY 1, 1993, THROUGH JULY 31, 2000, FOR TOTAL REIMBURSEMENT NOT EXCEEDING THIRTY-FIVE THOUSAND DOLLARS, AND TO PROVIDE THAT REQUESTS FOR COMPENSATION MUST BE SUBMITTED NO LATER THAN NINETY DAYS AFTER THE EFFECTIVE DATE OF THIS PROVISION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    (A)    Notwithstanding Section 35.3-E23, Part IB, Act 387 of 2000, the General Appropriation Bill, the Office of Indigent Defense shall retroactively submit reimbursement for all outstanding vouchers in the Appellate Conflict Fund occurring from July 1, 1993, through July 31, 2000. The total reimbursement of all vouchers combined shall not exceed thirty-five thousand dollars.

    (B)    All requests for compensation must be submitted to the Office of Indigent Defense no later than ninety days after the effective date of this joint resolution.

SECTION    2.    This joint resolution takes effect upon approval by the Governor.
