A BILL

TO AMEND SECTION 50-5-1505, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO SEASONS, TAKE AND SIZE LIMITS FOR SHAD, HERRING, AND STURGEON, SO AS TO CHANGE THE OPENING DATE FOR THE SEASON FOR TAKING SHAD IN A PORTION OF THE WINYAH BAY DRAINAGE SYSTEM FROM FEBRUARY FIFTEENTH TO FEBRUARY FIRST.

    Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 50-5-1505(1)(a)(ii)(1) of the 1976 Code, as last amended by Act 12 of 2001, is further amended to read:

    "(1)    Season: February 15 1 through April 15;"

SECTION 2.    Section 50-5-1505(1)(f) of the 1976 Code, as added by Act 245 of 2000, is amended to read:

    "(f)    Combahee River and all tributaries and distributaries thereto as follows:

        (i)    Tributaries and distributaries, except main stems of Salkehatchie Rivers: Season: No open season.

        (ii)    Main river above U.S. Highway 17-A bridge including main stems of Salkehatchie Rivers:

            (1)    Season: January 15 through March 31;

            (2)    Times: For setnets, Tuesday noon to Thursday Friday noon, local time; for driftnets, Monday noon to Saturday noon, local time;

            (3)    Methods and equipment: Any lawful method and equipment;

            (4)    Size and take limits: No limits.

        (iii)    Main river below U.S. Highway 17-A but above U.S. Highway 17 bridge:

            (1)    Season: January 15 through March 31;

            (2)    Times: For setnets, Tuesday noon to Thursday Friday noon, local time; for driftnets, Monday noon to Saturday noon, local time;

            (3)    Methods and equipment: Any lawful method and equipment;

            (4)    Size and take limits: No limits.

        (iv)    Main river seaward of U.S. Highway 17 bridge:

            (1)    Season: January 15 through March 31;

            (2)    Times: For setnets, Tuesday noon to Thursday Friday noon, local time; for driftnets, Monday noon to Saturday noon, local time;

            (3)    Methods and equipment: Any lawful method and equipment;

            (4)    Size and take limits: No limits."

SECTION    3.    This act takes effect upon approval by the Governor and is retroactive in its application to February 5, 2001.
