A BILL

TO PROVIDE A METHOD FOR FILLING VACANCIES ON THE BOARDS OF TRUSTEES OF LAURENS COUNTY SCHOOL DISTRICTS 55 AND 56 AND PROVIDE THAT A SPECIAL ELECTION IS NOT REQUIRED TO BE CONDUCTED IF ONLY ONE CANDIDATE OFFERS FOR OFFICE TO EITHER ONE OF THESE TWO SCHOOL DISTRICTS WHEN A VACANCY IN THE OFFICE OCCURS AND THE TIME FOR FILING FOR THE OFFICE HAS CLOSED AND HE HAS BEEN CERTIFIED; AND TO REPEAL ACT 292 OF 1989, RELATING TO FILLING VACANCIES ON BOARDS OF TRUSTEES OF LAURENS COUNTY SCHOOL DISTRICTS 55 AND 56.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    (A)    Notwithstanding any other provision of law, a vacancy on the boards of trustees of Laurens County School Districts 55 and 56 must be filled in the manner of original election for the unexpired term at the time of the next election for trustees of each of these school districts or by a special election if the vacancy occurs one hundred and eighty days or more before the next election for trustees.

    (B)(1)    A special election to fill a vacancy as provided in subsection (A) is not required to be conducted if the filing period for that office has closed, the candidate has been certified, and only one person has filed for that office.

        (2)    If the requirements of item (1) of this subsection have been met, the candidate who filed for the office is deemed elected and shall serve for a period of time intervening between the date of his certification and the date his successor is elected and qualifies at the next election for trustees. At that time, a person may file for election to the vacant trustee office for the remainder of the term, if it has not expired.

SECTION    2.    Act 292 of 1989 is repealed.

SECTION    3.    This act takes effect upon approval by the Governor.
