STATEMENT OF ESTIMATED FISCAL IMPACT

ESTIMATED FISCAL IMPACT ON GENERAL FUND EXPENDITURES:

EXPLANATION OF IMPACT:

    A review of this bill indicates there is no impact to the General Fund of the State, if this bill is enacted. It is projected that with the additional eight board members each meeting of the Board will cost an additional $1,800 (8 members x $225 per member/meeting). Section 25-21-10 of the Code of Laws of South Carolina, 1976, established the Veterans' Trust Fund of South Carolina as an eleemosynary corporation and expenditures of the fund are paid from the Trust Fund. This Trust Fund does not receive general fund appropriations and its budget is not included in the annual Appropriation Act.

A BILL

TO AMEND SECTION 25-21-20, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE BOARD OF TRUSTEES FOR THE VETERANS' TRUST FUND OF SOUTH CAROLINA, SO AS TO INCREASE THE NUMBER OF BOARD MEMBERS FROM ELEVEN TO NINETEEN, TO REQUIRE AT LEAST ELEVEN MEMBERS, RATHER THAN ALL OF THE MEMBERS, TO BE HONORABLY DISCHARGED VETERANS, AND TO DELETE THE PROVISION RESTRICTING MEMBERS FROM SERVING MORE THAN EIGHT CONTINUOUS YEARS ON THE BOARD.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 25-21-20 of the 1976 Code, as amended by Act 288 of 2000, is further amended to read:

    "Section 25-21-20.    There is created the Board of Trustees for the Veterans' Trust Fund of South Carolina composed of eleven nineteen members. The board shall utilize the staff of the Veterans' Affairs Division in order to carry out its duties, as provided in Section 25-21-30. One member of the board of trustees must be the Director of the Office of Veterans' Affairs Division or his designee. The Governor, with the advice and consent of the Senate, shall appoint individuals to fill the remaining positions on the board of trustees. Of the eighteen remaining positions filled by gubernatorial appointment, four must be county veterans' affairs officers, and five must represent veterans' service organizations, and one member must be selected at large. All At least eleven of the members of the board of trustees must be United States Armed Forces veterans who were honorably discharged; the remaining members are not required to be veterans; however, if any are veterans, they also must have been honorably discharged from the armed services. The members of the board shall elect officers from among themselves as necessary.

    Individuals appointed by the Governor shall serve at the pleasure of the Governor and may be removed by the Governor at any time. No member may serve more than eight continuous years.

    Members of the board who are not full-time employees of the State of South Carolina or any of its political subdivisions may be paid per diem, mileage, and subsistence at rates established by the board, not to exceed standards provided by law for state boards, commissions, and committees. Per diem, mileage, and subsistence may be paid to members of the board only for travel and costs incurred due to meetings of the board.

    A complete report of the activities of the Veterans' Trust Fund must be made to the General Assembly and State Auditor annually."

SECTION    2.    This act takes effect upon approval by the Governor.
