VERSIONS OF THIS BILL
TO AMEND SECTION 56-6-2910, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE OFFENSE OF RECKLESS HOMICIDE, SO AS TO REVISE THE PENALTY FOR A PERSON WHO IS CONVICTED OF, PLEADS GUILTY TO, OR PLEADS NOLO CONTENDERE TO THIS OFFENSE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 56-5-2910(A) of the 1976 Code, as last amended by Act 97 of 2001, is amended to read:
"(A) When the death of a person ensues within three years as a proximate result of injury received by the driving of a vehicle in reckless disregard of the safety of others, the person operating the vehicle is guilty of reckless homicide. A person who is convicted of, pleads guilty to, or pleads nolo contendere to reckless homicide is guilty of a felony and must be fined not less than one five thousand dollars nor more than five ten thousand dollars or imprisoned not more than ten fifteen years, or both. The department must revoke for five years the driver's license of a person convicted of reckless homicide."
SECTION 2. All proceedings pending and all rights and liabilities existing, acquired, or accrued at the time this act takes effect are saved. The provisions of this act apply prospectively to crimes and offenses committed on or after the effective date of this act.
SECTION 3. This act takes effect upon approval by the Governor.
