A BILL

TO IMPOSE A DISPOSAL FEE EQUAL TO ONE CENT ON EACH COPY OF A DAILY NEWSPAPER PUBLISHED AND CIRCULATED IN ANDERSON COUNTY, TO PROVIDE THE FEE REVENUES MUST BE CREDITED TO A SEPARATE FUND AND USED ONLY FOR ANTI-LITTER AND NEWSPRINT RECYCLING PROGRAMS, TO PROVIDE FOR THE MONTHLY PAYMENT OF THE FEE, AND TO PROVIDE A CIVIL PENALTY TO ENFORCE THE FEE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    (A)    There is imposed a disposal fee equal to one cent on each copy of a daily newspaper published and circulated in Anderson County. The fee is due and payable to the county treasurer by the tenth of each month for newspapers circulated in the county during the previous month. The fee must be credited to a fund in the county treasury separate and distinct from the general fund and all other funds, and the proceeds of the fund must be used by the governing body of the county only for anti-litter and newsprint recycling programs.

(B)    A publisher who fails to pay the fee or who fails to pay the fee in a timely manner may be assessed a civil penalty not to exceed five hundred dollars for each month the fee is not timely paid. Jurisdiction to enforce this civil penalty is in the magistrate's court.

SECTION    2.    This act takes effect upon approval by the Governor.
