A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING ARTICLE 21 TO CHAPTER 1, TITLE 1 SO AS TO PROVIDE THAT BEGINNING JULY 1, 2003, THE GENERAL ASSEMBLY, AND THE GOVERNING BODY OF ANY LOCAL POLITICAL SUBDIVISION OF THIS STATE, IN ORDER TO IMPOSE OR INCREASE ANY TYPE OF TAX OR FEE, MUST DO SO BY A TWO-THIRDS VOTE OF THE MEMBERS OF THE BODY.

Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 1, Title 1 of the 1976 Code is amended by adding:

"Article 21

Fee and Tax Increases

Section 1-1-1410.    Beginning July 1, 2004, the General Assembly and the governing body of any local political subdivision of this State authorized either to levy taxes or to imposed fees, or both, in order to impose or increase any type of tax or fee, in the manner permitted by law, must do so by a two-thirds vote of the members of the body. The provisions of this section supercede the positive majority voting requirement for local governing bodies to assess taxes or fees as provided in Article 3, Chapter 1 of Title 6.

SECTION    2.    This act takes effect upon approval by the Governor.
