A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-7-695 SO AS TO REQUIRE THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL TO ESTABLISH CRITERIA FOR APPROVING INDIVIDUALS TO AUTHORIZE THE CONSTRUCTION, INSTALLATION, AND USE OF SEPTIC TANKS, TO PROVIDE THAT SUCH AN INDIVIDUAL IS NOT AN AGENT OF THE DEPARTMENT, AND TO ALLOW AN INDIVIDUAL SEEKING SUCH AUTHORITY TO CONTRACT WITH AN INDIVIDUAL APPROVED BY THE DEPARTMENT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 7, Chapter 55, Title 44 of the 1976 Code is amended by adding:

"Section 44-7-695.    (A)    The department shall establish criteria under which individuals may be approved by the department to perform septic tank inspections and issue approvals and to perform any other action required for authorization to construct, install, or use a septic tank.

(B)    An individual approved pursuant subsection (A) is not an employee or an agent of the department and is acting in his own capacity. Such an individual may contract to provide services commensurate with his approval and may charge a reasonable fee for rendering these services.

(C)    An individual seeking authority to construct, install, or use a septic tank may contract with an individual approved by the department pursuant to subsection (A) to obtain the necessary authorization."

SECTION    2.    This act takes effect upon approval by the Governor.
