TO APPROVE REGULATIONS OF THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL, RELATING TO GROINS, DESIGNATED AS REGULATION DOCUMENT NUMBER 2758, PURSUANT TO THE PROVISIONS OF CHAPTER 39, TITLE 48 OF THE 1976 CODE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The regulations of the Department of Health and Environmental Control, relating to groins, designated as Regulation Document Number 2758, and submitted to the General Assembly pursuant to the provisions of Chapter 39, Title 48 of the 1976 Code, are approved.
SECTION 2. This joint resolution takes effect upon approval by the Governor.
The department is amending Regulations 30-1, 30-13, and 30-15 pursuant to S.C. Code Section 48-39-10 et seq. and Act 198, effective March 27, 2002. The amendments reflect changes to Section 48-39-290 relating to the permitting of groins seaward of the baseline. These changes will make the department's regulations regarding the construction and refurbishment of groins on the state's beaches consistent with the current statutory authority to permit these activities.
