A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-23-75 SO AS TO PROVIDE THAT A VALID MARINE DEALER'S PERMIT ENTITLES THE MARINE DEALER TO ALLOW A PROSPECTIVE PURCHASER OF A USED WATERCRAFT OR OUTBOARD MOTOR OWNED BY A DEALER OR A PERSON OTHER THAN THE DEALER TO USE THE WATERCRAFT OR MOTOR ON A TRIAL OR DEMONSTRATION BASIS FOR UP TO FORTY-EIGHT HOURS WITHOUT THE REQUIREMENT OF NEW REGISTRATION, NUMBERING, OR TITLING AND TO USE THE WATERCRAFT OR MOTOR AFTER PURCHASE UNTIL NEW REGISTRATION, NUMBERING, AND TITLING IS RECEIVED UNDER SPECIFIED CONDITIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 23, Title 50 of the 1976 Code is amended by adding:

"Section 50-23-75.    (A)    A valid marine dealer's permit held by a marine dealer entitles the marine dealer to allow a prospective purchaser of a used watercraft or outboard motor owned by the dealer or a person other than the dealer but in the dealer's possession for the purpose of resale or trade-in to use the watercraft or motor on a trial or demonstration basis for up to forty-eight hours without the requirement of new registration, numbering, or titling whether or not the registration, numbering, or titling has expired. Application for new registration, numbering, and titling is required after purchase but the purchaser may continue to use the watercraft or motor until this material is received if he or another authorized operator maintains in his possession while using the watercraft or motor a copy of the bill of sale evidencing the purchase and a copy of the submitted application for new registration, numbering, and titling. The department by regulation shall specify what written evidence is required to be carried by the prospective purchaser when operating the used watercraft or motor on a trial or demonstration basis before purchase.

(B)    The use of new watercraft or motors by prospective purchasers is governed by the provisions of Section 50-21-35."

SECTION    2.    This act takes effect upon approval by the Governor.
