TO APPROVE REGULATIONS OF THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL, RELATING TO SOFT DRINK BOTTLING PLANTS, DESIGNATED AS REGULATION DOCUMENT NUMBER 2856, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The regulations of the Department of Health and Environmental Control, relating to Soft Drink Bottling Plants, designated as Regulation Document Number 2856, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.
SECTION 2. This joint resolution takes effect upon approval by the Governor.
These amendments of R.61-32. Soft Drink Bottling Plants, will bring the regulation into compliance with the latest requirements set forth by the United States Food and Drug Administration (FDA) regarding bottled water manufacturing sanitation practices. These latest requirements have already been implemented by the Department under the authority of the FDA; these amendments will incorporate these requirements into South Carolina's regulation. Amendments will also ensure that the regulation complies with the requirements of the South Carolina Administrative Procedures Act, and will strengthen the Department's enforcement capability. The title of this regulation is being changed to clearly identify the regulation as being applicable to bottled water as well as soft drinks.
