THE COMMITTEE ON AGRICULTURE, NATURAL

RESOURCES AND ENVIRONMENTAL AFFAIRS

To whom was referred a Bill (S. 166) to amend Section 50-11-760, Code of Laws of South Carolina, 1976, relating to hunting from a public road, so as to amend the definition of, etc., respectfully

REPORT:

That they have duly and carefully considered the same and recommend that the same do pass:

A BILL

TO AMEND SECTION 50-11-760, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO HUNTING FROM A PUBLIC ROAD, SO AS TO AMEND THE DEFINITION OF "HUNTING".

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 50-11-760(B)(1) of the 1976 Code, as last amended by Act 69 of 2001, is further amended to read:

"(1)    For purposes of this section, 'hunting' includes:

(a)    taking deer by occupying stands for that purpose; and or

(b)    possessing, carrying, or having readily accessible:

(i)        a loaded centerfire rifle; or

(ii)    a shotgun loaded with shot size larger than number four."

SECTION    2.    This act takes effect upon approval by the Governor.
