A BILL

TO AMEND SECTION 61-4-520, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE REQUIREMENTS FOR OBTAINING A PERMIT AUTHORIZING THE SALE OF BEER OR WINE, SO AS TO PROVIDE THAT A LOCATION FOR WHICH AN APPLICATION FOR A PERMIT IS MADE WHICH IS WITHIN THREE HUNDRED FEET OF A SCHOOL, PLAYGROUND, OR CHURCH IS AN "UNSUITABLE" LOCATION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 61-4-520(7) of the 1976 Code, as added by Act 415 of 1996, is amended to read:

"(7)(a)    The department may consider, among other factors, as indications of unsuitable location, the proximity to residences, schools, playgrounds, and churches. This item subitem does not apply to locations licensed before April 21, 1986.

(b)    A location within three hundred feet of a school, playground, or church is an unsuitable location. For purposes of this subitem, the definitions of school, playground, and church in Section 61-6-120 apply and the distance must be measured as provided in that section. This subitem does not apply to locations licensed before July 1, 2003."

SECTION    2.    This act takes effect July 1, 2003.
