A JOINT RESOLUTION

TO AMEND ACT 761 OF 1964, RELATING TO THE CREATION OF THE ARKWRIGHT AREA FIRE DISTRICT IN SPARTANBURG COUNTY, SO AS TO ADD TWO ADDITIONAL MEMBERS TO ITS BOARD OF FIRE CONTROL WHO BOTH SHALL SERVE FOR A TERM OF SIX YEARS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 4 of Act 761 of 1964 is amended to read:

"SECTION 4.    After the creation of the Arkwright Area Fire District, there is established a board of fire control for the district to be composed of three members who shall be appointed by the Governor upon the recommendation of a majority of the Spartanburg County Legislative Delegation. Provided, that of those first appointed one member shall serve for a term of two years, one member shall serve for a term of four years, and one member shall serve for a term of six years or until their successors are appointed and qualify. Beginning on April 1, 2004, the Governor shall appoint two additional members upon the recommendation of a majority of the Spartanburg County Legislative Delegation who both shall serve for a term of six years or until their successors are appointed and qualify. The members of the board shall serve without pay and shall file annually a report with the Spartanburg County Board of Control not later than the first of November of each year, showing all activities and disbursements made by the board during the year.

If at least twenty per cent of the qualified electors residing in the district petition the commissioners of election by the first of September of any general election year, the commissioners shall call an election to be held at the following general election for the purpose of electing a member to the board to succeed the member whose term will expire during such year, for a six-year term. Thereafter, members shall be elected in each succeeding general election for terms of six years."

SECTION    2.    This joint resolution takes effect upon approval by the Governor.
