To whom was referred a Bill (S. 212) to amend Section 50-11-500, as amended, Code of Laws of South Carolina, 1976, relating to hunting wild turkey, so as to make it unlawful, etc., respectfully

REPORT:

That they have duly and carefully considered the same and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by

adding a new SECTION appropriately numbered to read:

/SECTION    ____.    Section 50-11-555 of the 1976 Code, as added by Act 255 of 2002, is amended to read:

"Section 50-11-555.    Notwithstanding any other provision of law, it is not unlawful to hunt wild turkey on Sunday on private land in Game Zone 4 during the prescribed season for hunting wild turkey." /

Amend the bill further, as and if amended, by striking SECTION 2 in its entirety.

Renumber sections to conform.

Amend title to conform.

ESTIMATED FISCAL IMPACT ON GENERAL FUND EXPENDITURES:

$0 (No additional expenditures or savings are expected)

EXPLANATION OF IMPACT:

The Department of Natural Resources indicates that this bill would have no fiscal impact on the agency, although it could result in a few additional tickets written annually for violations. Any fines would accrue to the County Fish and Game Fund.

LOCAL GOVERNMENT IMPACT:

Enactment would have little or no impact on local government expenditures.

SPECIAL NOTES:

The Board of Economic Advisors is the appropriate entity to address any revenue impact associated with this bill.

A BILL

TO AMEND SECTION 50-11-500, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO HUNTING WILD TURKEY, SO AS TO MAKE IT UNLAWFUL TO TAKE OR ATTEMPT TO TAKE A WILD TURKEY FROM A WATERCRAFT ON THE WATERS OF THE STATE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 50-11-500 of the 1976 Code, as last amended by Act 210 of 2002, is further amended by adding at the end:

"(9)    It is unlawful for a person to take or attempt to take a wild turkey from a watercraft on the waters of this State."

SECTION    2.    Chapter 1, Title 50 of the 1976 Code is amended by adding:

"Section 50-1-145.    Except for law enforcement or military personnel, it is unlawful to possess a shotgun loaded with buckshot or larger ammunition or a rifle loaded with ammunition larger than .22 in a water conveyance on the waters of this State. For purposes of this section, 'loaded' means any ammunition contained in any part of the weapon including a removable magazine or clip. A person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction, must be fined not less than one hundred dollars nor more than five hundred dollars or imprisoned not more than thirty days."

SECTION    3.    This act takes effect upon approval by the Governor.
