A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 57-5-610 SO AS TO PROVIDE THAT THE DEPARTMENT OF TRANSPORTATION MAY ALLOW CERTAIN BUSINESSES TO BE LOCATED WITHIN AN INTERSTATE HIGHWAY'S RIGHT-OF-WAY FOR A REASONABLE FEE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 3, Chapter 5, Title 57 of the 1976 Code is amended by adding:

"Section 57-5-610.    (A)    Notwithstanding another provision of law, the Department of Transportation may allow gasoline stations, restaurants, convenience stores, roadside assistance facilities, and public accommodations for restroom facilities to be located within an interstate highway's right-of-way.

(B)    The department shall charge a reasonable fee to the owner or operator of a business contained in subsection (A) for the privilege of having the business located within an interstate highway's right-of-way."

SECTION    2.    This act takes effect upon approval by the Governor.
