A JOINT RESOLUTION TO CREATE A STUDY COMMITTEE TO REVIEW THE CRIMINAL DOMESTIC VIOLENCE LAWS OF THE STATE AND MAKE RECOMMENDATIONS TO THE GENERAL ASSEMBLY CONCERNING ANY PROPOSED CHANGES AND TO REQUIRE THE STUDY COMMITTEE TO REPORT ITS RECOMMENDATIONS TO THE GENERAL ASSEMBLY NO LATER THAN JANUARY 31, 2009, AT WHICH TIME THE STUDY COMMITTEE MUST BE DISSOLVED.
Whereas, Act 166 of 2005 established the Criminal Domestic Violence Study Committee to study the criminal domestic violence laws of the State, the effects of criminal domestic violence on victims, perpetrators, and the economy of the State, and the status of the state's current domestic violence prevention programs, and to recommend appropriate changes to the General Assembly; and
Whereas, the Criminal Domestic Violence Study Committee studied criminal domestic violence and South Carolina's criminal domestic laws and, in June 2006, developed several recommendations regarding criminal domestic violence; and
Whereas, the Criminal Domestic Violence Study Committee met in September 2007 to receive an update regarding the status of the recommendations and determined that, while the General Assembly has taken numerous measures that have effectively addressed many of the criminal domestic violence issues, criminal domestic violence continues to be an ongoing problem for South Carolina. Now, therefore,
Be it enacted by the General Assembly of the State of South Carolina:
Criminal Domestic Violence Study Committee, created
SECTION 1. There is created a study committee to review the criminal domestic violence laws of the State and make recommendations to the General Assembly concerning any proposed changes.
Criminal Domestic Violence Study Committee, membership
SECTION 2. (A) The study committee must be composed of five members of the Senate, appointed by the President Pro Tempore, and five members of the House of Representatives, appointed by the Speaker of the House.
(B) Any vacancies in the membership of the study committee must be filled for the remainder of the unexpired term in the manner of original appointment.
(C) Members of the study committee may receive per diem, subsistence, and mileage as provided by law for members of state boards, committees, and commissions.
Criminal Domestic Violence Study Committee, report
SECTION 3. The study committee shall make a report of its recommendations to the General Assembly no later than January 31, 2009, at which time the study committee must be dissolved.
Time effective
SECTION 4. This joint resolution takes effect upon approval by the Governor.
