A BILL

TO AMEND SECTION 58-17-1200 OF THE 1976 CODE, RELATING TO THE ACQUISITION OF REAL ESTATE BY A RAILROAD COMPANY, TO ELIMINATE A RAILROAD COMPANY'S CONDEMNATION AUTHORITY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 58-17-1200 of the 1976 Code is amended to read:

"Section 58-17-1200.    For the purposes mentioned in Section 58-17-1190, if necessary, any railroad company may acquire and hold real estate by purchase or gift and hold real estate necessary, and if the real estate is not acquired by purchase or gift, the railroad company may acquire it by condemnation."

SECTION    2.    This act takes effect upon approval by the Governor.
