A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-31-60 SO AS TO PROVIDE A PROCEDURE WHEREBY A GOVERNING AUTHORITY MAY COLLECT FINES ASSOCIATED WITH PARKING CITATIONS ISSUED TO OWNERS OF RENTAL AUTOMOBILES AND VEHICLES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 31, Title 56 of the 1976 Code is amended by adding:

"Section 56-31-60.    (A)    A fine assessed by a citation against a rented private passenger automobile or rental vehicle for violating a provision that regulates the parking of vehicles may not increase in value for a period of sixty days from the date the citation is issued. If the fine is not satisfied within sixty days, then the fine may be increased pursuant to the schedule of fines approved by the governing authority that issued the parking citation.

(B)    A rental company whose vehicle has been issued a citation contained in subsection (A) must be notified of the citation within forty-five days of its issuance if it has not been satisfied.

(C)    If a citation remains outstanding against a rented private passenger automobile or rental vehicle registered in this State at least sixty days, then the governing authority that issued the citation may notify the Department of Motor Vehicles that it holds an outstanding parking violation citation against the vehicle. Once the department receives this notification, it may not issue to the vehicle's owner a new vehicle registration, license plate, or renewal sticker until the parking citation has been satisfied and all fines associated with the citation have been paid. The department must place all fines collected pursuant to this subsection in a special account and distribute them to the governing authority that issued the citation.

(D)    A rental company whose vehicle is subject to the provisions contained in this section, may retroactively charge the credit card of record of the renter for fines from parking citations attributable to the vehicle while in the renter's possession."

SECTION    2.    This act takes effect upon approval by the Governor.
