A JOINT RESOLUTION TO EXTEND UNTIL JANUARY 31, 2008, THE TIME IN WHICH THE EMINENT DOMAIN STUDY COMMITTEE, ESTABLISHED TO FORMULATE RECOMMENDATIONS CONCERNING THE CONDEMNATION AUTHORITY OF ALL ENTITIES THAT POSSESS THE POWER OF EMINENT DOMAIN IN SOUTH CAROLINA, THE EFFECT OF GOVERNMENTAL POLICY ON THE VALUE AND OWNERSHIP OF PRIVATE PROPERTY, AND THE NEED FOR REVISION OF CURRENT SLUM CLEARANCE AND REDEVELOPMENT USES OF EMINENT DOMAIN IN SOUTH CAROLINA, HAS TO PRESENT ITS REPORT AND RECOMMENDATIONS TO THE CHAIRMAN OF THE SENATE JUDICIARY COMMITTEE, THE CHAIRMAN OF THE HOUSE JUDICIARY COMMITTEE, AND THE GOVERNOR.

Whereas, S.1029, Act 458 of 2006 created the Eminent Domain Study Committee to formulate recommendations concerning the condemnation authority of all entities that possess the power of eminent domain in South Carolina, the effect of governmental policy on the value and ownership of private property, and the need for revision of current slum clearance and redevelopment uses of eminent domain in South Carolina; and

Whereas, S.529, Ratification Number 19 of 2007, extended from March 15, 2007, to April 17, 2007, the time in which the Eminent Domain Study Committee shall submit its report to the chairman of the Senate Judiciary Committee, the chairman of the House Judiciary Committee, and the Governor; and

Whereas, the Eminent Domain Study Committee requires additional time in order to complete its report. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

Reporting date

SECTION    1.    The time in which the Eminent Domain Study Committee shall submit its report to the chairman of the Senate Judiciary Committee, the chairman of the House Judiciary Committee, and the Governor is extended from April 17, 2007, to January 31, 2008, at which time the committee then shall be dissolved.

Time effective

SECTION    2.    This joint resolution takes effect upon approval by the Governor, and the study committee continued by Section 1 of this joint resolution dissolves upon the filing of its report.

Ratified the 29th day of May, 2007.

Approved the 1st day of June, 2007.
