AN ACT TO AMEND ACT 503 OF 1982, AS AMENDED, SO AS TO CONFORM THE PETITION FILING DEADLINE FOR SCHOOL BOARD CANDIDATES FOR THE AIKEN COUNTY BOARD OF EDUCATION WITH THE UNIFORM STATEWIDE FILING DEADLINE FOR PETITION CANDIDATES PROVIDED FOR IN SECTION 7-13-351 AND TO CONFORM THE STATEMENT OF CANDIDACY FILING DEADLINE WITH THE UNIFORM STATEWIDE FILING DEADLINE SET FORTH IN SECTION 7-13-352.

Be it enacted by the General Assembly of the State of South Carolina:

To conform the petition filing and statement of candidacy filing deadlines with statutory law

SECTION    1.    Section 4 of Act 503 of 1982 is amended to read:

"Section 4.    Members of the County Board of Education must be elected in elections held in each even-numbered year at the time of the general election to succeed the members whose terms expire. The Aiken County Election Commissioners shall conduct the election, canvass the vote, and certify the results. Managers in each precinct for the general election shall serve as managers of the board of education election. The laws of the general election apply except as otherwise specified in this section. The Aiken County Election Commission shall list as a candidate any qualified resident elector upon a showing that fifty or more electors of the geographical area of the district for which an individual offers as a candidate have signed a request that his name be listed. All nominating petitions must be in the hands of the chairman of the election commission by twelve o'clock noon on July fifteenth, or if July fifteenth falls on Saturday or Sunday, not later than twelve o'clock noon on the following Monday. Any person desiring to be considered as a write-in candidate for such election must qualify by a statement of candidacy which must be filed with the chairman of the election commission not later than twelve o'clock noon on August fifteenth, or if August fifteenth falls on Saturday or Sunday, not later than twelve o'clock noon on the following Monday. Each candidate must affirm in writing that he meets the qualifications for the office sought and give a notice of willingness and intent to serve if elected. A ballot separate from general election ballots must be provided at each precinct where the election is held by the Aiken County Election Commission."

Time effective

SECTION    2.    This act takes effect upon approval by the Governor.

Ratified the 31st day of January, 2008.

Approved the 4th day of February, 2008.
