A BILL

TO AMEND SECTION 47-5-50, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PROHIBITIONS ON THE SALE OF WILD CARNIVORES AND DOMESTICATED FERRETS AS PETS, SO AS TO PROVIDE THE STATUTE DOES NOT APPLY TO FACILITIES INSPECTED BY THE UNITED STATES DEPARTMENT OF AGRICULTURE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 47-5-50(D) of the 1976 Code, as last amended by Act 343 of 2002, is further amended to read:

"(D)    This section does not apply to:

(1)    the sale, purchase, donation, or transfer of ownership of carnivores between publicly-owned zoos or animal dealers located in this State and licensed by the United States Department of Agriculture (USDA) under the Animal Welfare Act on the effective date of this chapter. These exemptions do not allow for the sale, purchase, donation, or transfer of ownership to private individuals in this State. Any public displays, showings, or exhibitions of wild carnivores, primates, or any other animals for which a USDA licensed rabies vaccine does not exist are allowed only when these displays, showings, or exhibitions prevent any possible contact by these animals with the members of the general public.; and

(2)    facilities inspected by the USDA."

SECTION    2.    This act takes effect upon approval by the Governor.
