A JOINT RESOLUTION

TO APPROVE REGULATIONS OF THE DEPARTMENT OF AGRICULTURE, RELATING TO GASOLINE, LUBRICATING OILS AND OTHER PETROLEUM PRODUCTS, DESIGNATED AS REGULATION DOCUMENT NUMBER 3123, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    The regulations of the Department of Agriculture, relating to Gasoline, Lubricating Oils and Other Petroleum Products, designated as Regulation Document Number 3123, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.

SECTION    2.    This joint resolution takes effect upon approval by the Governor.

SUMMARY AS SUBMITTED

BY PROMULGATING AGENCY.

The Department of Agriculture proposes these amendments to clarify and to provide a more efficient process for regulating and analyzing petroleum products, as authorized by S.C. Code, Title 39, Chapter 41. Specifically, new language is being adopted to allow the Department to adequately regulate advances in the standards of traditional petroleum products, as well as alternative fuels that are likely to become more mainstream and more widely utilized by South Carolinians as a source of fuel. In addition, the process for registering petroleum products has been updated and made more efficient for both the Department and the registrant in the event of a traceback situation, by requiring all invoices to be maintained by the retailer for at least 30 days after delivery of the petroleum products.
