A BILL

TO PROVIDE THAT THE ELECTED POSITION OF SUPERINTENDENT OF EDUCATION OF OCONEE COUNTY IS ABOLISHED AS OF JULY 1, 2009, AND ALL POWERS AND DUTIES OF THE SUPERINTENDENT ARE DEVOLVED UPON THE BOARD OF TRUSTEES OF THE SCHOOL DISTRICT OF OCONEE COUNTY AND TO PROVIDE THAT IF A VACANCY OCCURS IN THAT OFFICE BEFORE JULY 1, 2009, THE OFFICE IS ABOLISHED AS OF THE DATE OF THE VACANCY; AND TO REPEAL SECTIONS 1, 4, AND 8 OF ACT 613 OF 1992, AS AMENDED, RELATING TO THE ELECTION, POWERS, AND DUTIES OF THE SUPERINTENDENT OF EDUCATION OF OCONEE COUNTY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    The elected position of Superintendent of Education of Oconee County is abolished as of July 1, 2009, and all the powers and duties of the elected superintendent are devolved upon the Board of Trustees of the School District of Oconee County. If a vacancy occurs in the elected office of superintendent of education before July 1, 2009, the office is abolished as of the date the vacancy occurs.

SECTION    2.    Sections 1, 4, and 8 of Act 613 of 1992, as last amended by Act 429 of 2006 are repealed, July 1, 2009, or if a vacancy occurs in the elected office of Superintendent of Education of Oconee County before July 1, 2009, these sections are repealed as of the date the vacancy occurs.

SECTION    3.    This act takes effect upon approval by the Governor.
