THE COMMITTEE ON FISH, GAME AND FORESTRY

To whom was referred a Bill (S. 1068) to amend Section 50-1-30, Code of Laws of South Carolina, 1976, relating to the classification of birds, animals, etc., respectfully

REPORT:

That they have duly and carefully considered the same and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by adding an appropriately numbered new SECTION to read:

/SECTION    __.    Section 50-9-920(B) of the 1976 Code is amended by adding an appropriately numbered new item to read:

"(    ) resident and nonresident migratory waterfowl permit shall be used for the management of waterfowl habitats and for the development, protection, and propagation of waterfowl in this State, provided that no revenue generated from the sale of a waterfowl permit may be expended for administrative salaries."        /

Renumber sections to conform.

Amend title to conform.

A BILL

TO AMEND SECTION 50-1-30, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE CLASSIFICATION OF BIRDS, ANIMALS, AND FISH, SO AS TO CLASSIFY CERTAIN BIRDS AS MIGRATORY WATERFOWL; TO REPEAL SECTION 50-11-20 RELATING TO THE MIGRATORY WATERFOWL COMMITTEE; AND TO REPEAL SECTION 50-9-670 RELATING TO MIGRATORY WATERFOWL PERMITS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 50-1-30 of the 1976 Code is amended by adding an appropriately numbered item to read:

"( )    Migratory waterfowl: members of the family 'Anatidae' including brants, ducks, geese, and swans."

SECTION    2.    A.     Section 50-11-20 of the 1976 Code is repealed.

B.    Section 50-9-670 of the 1976 Code is repealed on July 1, 2021.

SECTION    3.    Except as otherwise provided, this act takes effect upon approval by the Governor.
