TO AUTHORIZE THE CITY OF ORANGEBURG TO RELOCATE THE CONFEDERATE VETERAN STATUE, LOCATED IN THE ORANGEBURG MEMORIAL PLAZA, TO THE ORANGEBURG CONFEDERATE CEMETERY.
Whereas, a Confederate Veteran Statue is located on the Orangeburg Memorial Plaza; and
Whereas, the City of Orangeburg desires to change the layout of the Orangeburg Memorial Plaza; and
Whereas, in a unanimous resolution adopted on June 30, 2020, the City of Orangeburg City Council and the mayor of the City of Orangeburg expressed their desire to relocate the Confederate Veteran Statue; and
Whereas, the Old Dixie Club Library also known as Dixie Hall is a location of historical significance within the City of Orangeburg that has long served as a meeting place for patriotic groups; and
Whereas, the Pioneer Graveyard, also known as the Old Pioneer Cemetery, a burial site for Confederate soldiers, is a historic location at the Dixie Hall site; and
Whereas, the City of Orangeburg desires to preserve the history and value of the Confederate Veteran Statue, originally erected in 1893 by dedicated citizens, by relocating it to the Pioneer Graveyard, while also facilitating the reconfiguration of the Orangeburg Memorial Plaza. Now, therefore,
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The City of Orangeburg is hereby authorized to relocate the Confederate Veteran Statue, including its base and attached placards, from its current location in the Orangeburg Memorial Plaza at the intersection of Russell Street and Church Street to a location approximately three-tenths of one mile away outside of the historic Dixie Hall and the Old Pioneer Cemetery. Upon its relocation, access to the Confederate Veteran Statue will remain open to the public.
SECTION 2. The City Council of Orangeburg and the Mayor of the City of Orangeburg have unanimously resolved to relocate and preserve the historic Confederate Veteran Statue. The proposed new location for the Confederate Veteran Statue is a historic landmark and resting place for confederate soldiers. Under the exigencies of this particular case, the General Assembly has a logical basis and sound reason for enacting this legislation.
SECTION 3. The General Assembly finds that the sections presented in this act constitute one subject as required by Article III, Section 17 of the South Carolina Constitution, in particular finding that each change and each topic relates directly to or in conjunction with other sections to the subject of the relocation of the Confederate Veteran Statue in the City of Orangeburg as clearly enumerated in the title.
The General Assembly further finds that a common purpose or relationship exists among the sections, representing a potential plurality but not disunity of topics, notwithstanding that reasonable minds might differ in identifying more than one topic contained in the act.
SECTION 4. This act takes effect upon approval by the Governor.
