AN ACT TO PROVIDE FOR THE BUDGET AND TAX LEVIES OF FLORENCE COUNTY SCHOOL DISTRICT FOUR, AND TO PROVIDE FOR THE MANNER OF ELECTION OF THE BOARD OF TRUSTEES OF FLORENCE COUNTY SCHOOL DISTRICT FOUR; AND TO PROVIDE THAT FLORENCE COUNTY SCHOOL DISTRICT FOUR IS EXEMPTED FROM THE REQUIREMENTS OF ACT 806 OF 1952, AS AMENDED, RELATING TO THE ELECTION OF SCHOOL BOARD TRUSTEES, BUDGETS, AND APPROVAL OF TAX LEVIES.
Be it enacted by the General Assembly of the State of South Carolina:
Budget and taxation authority
SECTION 1. Notwithstanding any other provision of law, the powers and duties of taxation for school purposes for Florence County School District Four are devolved upon the Board of Trustees of Florence County School District Four. The Florence County School District Four Board of Trustees shall adopt the district's annual budget by a majority vote of the trustees at a public meeting in June of each year following two reasonably publicized public hearings on the subject of the district's budget. Following the adoption of a budget by the board, the chairperson of the board must certify the budget to the Florence County Auditor. However, the board of trustees is prohibited from adopting a budget which requires a millage increase of more than ten mills over the prior fiscal year unless the increase is required to comply with a provision of state law, without receiving the approval of a majority of qualified electors voting in a referendum scheduled within sixty days of the budget's adoption. At the request of the board, the Florence County Election Commission shall conduct the referendum pursuant to the election laws of the State, mutatis mutandis.
Elections
SECTION 2. Notwithstanding any other provision of law, the Board of Trustees of Florence County School District Four, beginning with the election for trustees in 2002, must be elected at the general election in November or on the first Tuesday following the first Monday in November in any year a November general election is not held. The Florence County Election Commission shall conduct the election. The trustees whose terms expire in June of 2002, 2003, and 2004, continue to serve until their successors are elected and qualified following the elections provided for in the years 2002, 2003, and 2004, respectively. For the election to be held in June 2001, the polls must be open from 7:00 a.m. to 7:00 p.m.
Exemption
SECTION 3. Florence County School District Four is exempted from the requirements of Act 806 of 1952, as amended by Act 817 of 1964 and Act 169 of 1995.
Repeal
SECTION 4. All acts or parts of acts inconsistent with this act are repealed.
Time effective
SECTION 5. This act takes effect upon approval by the Governor.
